Billings and charges

DKL Studio offers transparent tuition standard for all programs. The hours that each family purchases will expire after a mutually agreed upon date of expiration. The non-refundable portion of the pre-paid tuition cannot be transferred among different families; however it can be transferred among members of the same family.

The client agrees to authorize DKL Studio to charge the tuition in full for the contracted program to the credit card provided, immediately upon mutual signage of the service agreement.

If a client prefers to pay by other methods other than the credit card on file with DKL Studio, the client must notify DKL studio and make the payment by a contracted point of time. Otherwise, the client authorizes DKL studio to charge the contracted payment in full amount, to the credit card on file upon the first teaching session.

The client shall not pay any DKL instructor directly. All payments from the client must be exclusively paid to DKL company account. In addition, all client referrals must be directed to DKL studio, and contracted with DKL Studio before any DKL instructor can provide services to the referred client.

Additional teaching sessions and payment

DKL Studio typically offers tuition rate based on teaching sessions, with each session defined for a certain amount of minutes or hours. All teaching sessions will include 10 minutes of break for both the teachers and the students.

If a client completed more teaching sessions that originally contracted, the client authorized DKL Studio to charge to the payment method on file for any additional hours the client has used at the originally contracted rate for the services.

Please speak regularly to your DKL sales consultant throughout the program, so you can be advised about the amount of sessions you have completed.

Adult supervision

Please be advised that unless specially arranged, DKL Studio teachers are not permitted to offer tutor sessions at the students house, or a in public venue such as a library or a cafe. A DKL tutoring session can be executed either through DKL online classroom, or in person in a DKL classroom.

In the case that the session is executed online, a minor student must be supervised by a parent or guardian. During the online teaching session, a DKL instructor has the rights to check and make sure at least one parent, or adult ​guardian, is present in the same house with the student. In the case that no adult can be found in the same house, the Instructor has the rights to terminate the session, and DKL center will immediately call the parent or guardian registered ​on DKL student profile.​

The client will be charged under the cancellation policy because the session was effectively cancelled without 4 hours notice in advance. In the case that the parent or guardian leaves the house before the ending of a session, the tutor will also leave the session at the same time, and the client will be charged for the entire session.

In the case that the session is executed in a DKL classroom, a parent or a guardian must be waiting in the DKL studio venue. The liability of supervision during the teaching session, or any time during the minor student’s physical presence in the DKL studio venue does not transfer to any DKL staff member. The parent or a guardian should be fully liable of supervision at all times.

The adult supervision requirement does not apply to students who are eighteen years or older.

Arbitrary terms

Arbitration & Class / Collective Action Waiver

Any and all disputes arising out of or relating to these terms and conditions, other than disputes relating to intellectual propertyInfringement, including whether the dispute is arbitrable and the scope of this arbitration agreement, shall be finally resolved by Arbitration administered by a single arbitrator under the then-applicable commercial rules of the American Arbitration Association In accordance the Federal Arbitration Act. The arbitration shall be governed by and construed by federal law to the fullest extent Possible. Unless otherwise agreed by the parties, the arbitration shall take place in Las Vegas, Nevada. Judgement on the arbitral Award may be entered in any court having jurisdiction thereof. The applicable statute of limitations will apply to all claims raisedIn any arbitration demand. Failure to demand arbitration within the prescribed statutory limitation period shall result in waiver ofsaid claims.

To the maximum extent permitted by law, should you wish to initiate an arbitration action against DKL Studio, you will not assertClass, collective, or representative action claims against DKL Studio. The same applies to any arbitration action by DKL Studio againstYou. Thus, you and DKL Studio agree that each may submit only their own individual claims in arbitration and will not seek to representThe interest of any other person through a class, collective or representative action in court or arbitration or other forum. Further, unlessBoth you and DKL Studio agree otherwise, the arbitrator may not consolidate more than one person’s claims and may not otherwisePreside over a representative or class proceeding.

Limitation of Liability

DKL Studio will not be liable to you or to any other person for any indirect, consequential, punitive or special damages, of any character,whether in an action in contract, tort or otherwise, arising out of or in connection with your DKL Studio program, even if DKL Studiohas been advised of the possibility of such damages. Unless this limitation of liability is prohibited by law, DKL Studio’s total aggregate liability arising from or related to your DKL Studio programWill not exceed the amount you paid for your program.

Non-solicitation Agreement

By becoming a DKL client, you agree that you will not solicit for employment, hire or permit any organization directly or indirectly controlled by you to solicit for employment or hire anypersonnel of DKL Studio at any time during the defined course of the service agreement, and for a period of two years thereafter. Miscellaneous

These terms and conditions supersede all prior oral or written agreements, if any, between the parties and constitutes The entire agreement between the parties. The agreement cannot be changed or modified orally. Any change or modification Must be in writing and agreed to by both parties. If any provision of these terms is found to be unenforceable for any reason, such provision shall be construed by limiting it to make it enforceable to the maximum extent permitted by law, And the remainder of the terms shall continue in full force and effect

Acceptance of These Terms and Conditions

I understand that by checking the “I agree to enrollment terms” checkbox when prompted, I acknowledge that (1) I have read​ and that I agree to these enrollment terms and conditions, (2) I understand that DKL Studio does not guarantee acceptance to​ any school or passing score on any exam. You must be 18 years of age or older to accept these terms and conditions. If you are​ less than 18 years of age, you must have a parent or guardian accept on your behalf. Checking the “I Agree” checkbox is a​ representation from you that you are at least 18 years of age.​

Cancellation/Refund Policies

For all DKL programs, the tuition is 100% refundable before the first schedule session starts. In the case that the parent sends an application in written by the second scheduled session (including the time after the first scheduled session and before the second ​scheduled session), the tuition for the unexecuted portion of program can be refunded at ninety percent (90%).

Once the student has started the the second scheduled session, the tuition is non-refundable. The tuition is not transferrable among students, but it can be transferred among siblings within the same family.

Postponing/Cancellation of Teaching Sessions Policies

Out of each 12-week term, a student can ask for cancellation for a maximum of 3 weeks. All cancellations must be sent in writing, and be confirmed in writing by a DKL administration personnel, with a four (4) hours notice in advance of the scheduled start time. In the case that a family asks for more than 3 weeks of cancellation within a 12-week term, or fails to give notice about the cancellation in writing, the tuition will be deducted as if the session is executed by schedule.
